Terms of Service

Welcome to leiakv, a real estate platform operated by MOONSHIP OÜ (registry code: 14963506, address: Pajusaare tee, Peetri alevik, 75312, Estonia). These Terms of Service govern your access to and use of our platform. By accessing or using leiakv, you agree to be bound by these terms. If you do not agree with any part of these terms, you may not use our services.

1. Definitions

  • Platform: The leiakv website, mobile applications, and all related services operated by MOONSHIP OÜ.
  • User: Any natural or legal person who accesses or uses the Platform, whether registered or not.
  • Listing: Any real estate advertisement published on the Platform.
  • Content: All text, images, videos, documents, and other materials uploaded to the Platform.
  • Services: All features and functionalities offered through the Platform.

2. User Types and Registration

The Platform offers different levels of access:

Visitor: May browse public listings and search properties without registration.

Registered User: May create listings, save favorites, receive notifications, send inquiries, and access personal dashboard. Registration requires providing accurate personal information and accepting these Terms.

Broker/Agency: May access additional features including bulk listing management, enhanced statistics, professional profile pages, and premium placement options. Requires valid business registration and professional credentials.

Registration Requirements

  • You must be at least 18 years old and legally capable of entering binding contracts.
  • All registration information must be accurate, current, and complete.
  • You are responsible for maintaining the confidentiality of your account credentials.
  • Each person or legal entity may maintain only one account unless otherwise authorized.
  • You must promptly update your account information if it changes.

3. Platform Services

leiakv provides a platform for real estate advertising and search. Our services include:

  • Publishing property sale and rental listings with photos, descriptions, and contact information.
  • Searching and filtering properties by location, type, price, and other criteria.
  • Facilitating communication between property advertisers and interested parties.
  • Email notifications (E-Agents) for new properties matching saved search criteria.
  • Saving and managing favorite listings.
  • Premium services including featured listings, priority placement, and enhanced visibility.
  • Statistics and insights for listing performance (for registered users and brokers).

leiakv acts solely as an advertising platform. We do not participate in property transactions, provide real estate brokerage services, or guarantee the accuracy of any listing information.

4. Listing Requirements and Content Standards

When publishing listings, you must ensure that:

  • You have legal authority to advertise the property (as owner, authorized representative, or licensed broker).
  • All information including location, size, price, condition, and amenities is accurate and not misleading.
  • The listing is kept current and removed promptly when the property is no longer available.
  • The content complies with all applicable laws, including fair housing and anti-discrimination regulations.
  • You own or have obtained all necessary rights to any photos, videos, or documents uploaded.
  • Photos accurately represent the current condition of the property.

Prohibited Content

  • False, misleading, or deceptive information about properties.
  • Content that discriminates based on race, ethnicity, religion, gender, sexual orientation, disability, or other protected characteristics.
  • Offensive, threatening, defamatory, or obscene material.
  • Content promoting illegal activities or violating third-party rights.
  • Files containing viruses, malware, or harmful code.
  • Duplicate listings, spam, or irrelevant content.

leiakv reserves the right to review, modify, or remove any content that violates these standards without prior notice.

5. User Obligations

By using the Platform, you agree to:

  • Use the Platform only for lawful purposes related to real estate search or advertising.
  • Provide truthful and accurate information in all interactions.
  • Treat other users, our staff, and the Platform with respect.
  • Keep your account credentials secure and notify us immediately of any unauthorized access.
  • Comply with all applicable laws, regulations, and these Terms.

You must not:

  • Engage in fraudulent activities or misrepresent your identity or authority.
  • Harass, abuse, threaten, or discriminate against other users.
  • Attempt to interfere with, disrupt, or gain unauthorized access to the Platform's systems.
  • Use automated tools to scrape, copy, or collect data from the Platform without authorization.
  • Circumvent or attempt to circumvent any security measures or access restrictions.
  • Use contact information obtained through the Platform for purposes other than genuine property inquiries.

6. Intellectual Property Rights

Platform Rights

The Platform, including its design, logos, trademarks, software, and all original content, is the exclusive property of MOONSHIP OÜ. You may not copy, modify, distribute, or create derivative works without our express written permission.

User Content License

By uploading content to the Platform, you grant MOONSHIP OÜ a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, adapt, translate, distribute, and display the content for the purpose of operating, promoting, and marketing the Platform and its listings. This includes, but is not limited to, distribution to partner platforms, other platforms operated by MOONSHIP OÜ, third-party social media platforms and groups (such as Facebook groups, Instagram, and similar channels), real estate marketplaces, and any other channels where real estate listings may be shared. Shared listings may include property photos, descriptions, pricing, and a link back to the Platform. You retain ownership of your original content and may delete it at any time, which will terminate the license for future use.

You warrant that you have all necessary rights to the content you upload and that it does not infringe on any third-party intellectual property rights.

7. Fees and Payment

Certain services on the Platform require payment:

  • Prices are displayed in euros and include applicable VAT unless otherwise stated.
  • Payment can be made via bank transfer, credit/debit card, or other methods specified on the Platform.
  • Paid services are activated upon confirmation of payment.
  • Fees for digital services are generally non-refundable once the service has been provided. Exceptions may apply as required by consumer protection laws.
  • We reserve the right to modify pricing with reasonable advance notice. Price changes do not affect services already purchased.

For consumers in the European Economic Area: By requesting immediate activation of digital services upon purchase, you acknowledge that you lose your right of withdrawal under the Consumer Rights Directive once the service is fully provided.

8. Limitation of Liability

To the maximum extent permitted by law:

  • The Platform is provided 'as is' and 'as available' without warranties of any kind, either express or implied.
  • We do not guarantee uninterrupted, secure, or error-free access to the Platform.
  • We are not responsible for the accuracy, completeness, or legality of user-generated content, including property listings.
  • We are not a party to any transaction between users and bear no responsibility for property conditions, negotiations, or disputes arising from such transactions.
  • We are not liable for actions of third parties, including other users, or for any viruses or harmful components transmitted through the Platform.
  • We are not liable for any indirect, incidental, special, consequential, or punitive damages.

9. Account Suspension and Termination

Termination by Us

We may suspend or terminate your access to the Platform at any time if we believe you have violated these Terms, engaged in fraudulent or illegal activity, or for any other reason at our discretion. We will provide notice when reasonably possible.

Termination by You

You may terminate your account at any time by contacting us or using the account deletion feature in your profile settings. Upon termination, your active listings will be removed.

Effects of Termination

  • Your access to the Platform and all associated services will be revoked.
  • Your listings and content will be removed, except for data we are required to retain by law.
  • Fees already paid are non-refundable.
  • Provisions regarding intellectual property, limitation of liability, and dispute resolution survive termination.

10. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on the Platform and, where appropriate, by email. Your continued use of the Platform after such changes constitutes acceptance of the new Terms. If you do not agree with the changes, you must stop using the Platform and may terminate your account.

11. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Republic of Estonia, without regard to its conflict of law provisions.

Dispute Resolution

  • Any dispute arising from these Terms or your use of the Platform shall first be attempted to be resolved through good-faith negotiations.
  • You may submit complaints to [email protected]. We will respond within a reasonable time.
  • EU consumers may also file complaints with the Consumer Disputes Committee at the Estonian Consumer Protection and Technical Regulatory Authority (TTJA) — www.ttja.ee.
  • If a dispute cannot be resolved through negotiation, it shall be submitted to the exclusive jurisdiction of Harju County Court, Estonia.

12. General Provisions

  • These Terms, together with our Privacy Policy, constitute the entire agreement between you and MOONSHIP OÜ regarding the Platform.
  • If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
  • Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
  • You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights and obligations without restriction.
  • We shall not be liable for any failure to perform our obligations due to circumstances beyond our reasonable control (force majeure).
